General Terms and Condition
1. Clever Botanics
a) "Clever Botanics" is the trademark and owned by The GreenSome Ltd in the U.K. and in other countries.
b) The material in the Web Site is copyright to Clever Botanics Retail limited or our content and technology providers. You are welcome to view, print and download the contents of the Web Site for personal use, but not for any commercial purposes or re-publication.
2. Web Site Information
a) We have tried to ensure that the information provided in the Web Site/Web Shop is accurate. However, we make no representation and give no warranty of any kind in respect of the information and the data visible to public.
b) We do not accept liability for any loss (direct, indirect or consequential) which may arise from reliance on information contained in the Web Site or in respect of any error or omission, except in relation to death or personal injury caused by our negligence.
3. Description of Products
a) The description and specification of products in the Web Site is only approximate and we reserve the right to make changes which do not materially affect the quality or performance of those products.b) We may correct any error appearing in the Web Site/Web Shop or the related Applications on iOS and Android or withdraw any product from sale without incurring liability. Price and availability are also subject to change without notice.
4. Ordering Products
a) You may order products from the Web Site/Web Shop by submitting a completed order form through the check-out procedure.
b) We will confirm acceptance of your order by e-mail to the address you have given, and the sending of this e-mail (whether or not it is received) makes the contract between us.
5. The Price and Payment
a) The price of the products will be the price quoted in the Web Site/Web Shop or related Mobile Apps at the time we accept your order. The price will include any applicable value added tax, but not the cost of delivery.
b) In addition to the price, you will have to pay our delivery charges as quoted in the Web Site/Web Shop at the time we accept your order - unless you qualify for free delivery. The amount of these charges varies according to the method of delivery and the delivery address you specify in your order. Overseas purchasers may require additional shipping or local duty and taxes that will be purchasers responsibility.
c) Payment is made by credit card or Bank2Bank Transfers at the time we accept your order. (the payment methods we accept are listed in the Web Site/Web Shop at the time you place your order). Refunds will generally be made by means of a credit to your original payment method.
d) Although every care is taken in the quality of content on this site, there may occasionally be an error and items may be mis-priced. In this event, we will either: contact you to ask if you wish to cancel the order, or just cancel the order and notify you, at our own discretion. We are under no obligation to supply goods at the incorrect price that may have been resulted from a bug in the Web Solution or caused by an unintentional mistake by web editors and administrator.
e) If one chooses the direct payment gateway to complete your purchase, then the webshop does store your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
f) All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
g) We require full payment for your purchase and it must be received before shipment from our warehouse. We reserve the right to change and revise our payment methods from time to time if necessary. All payments must be made to GBP equivalent.
h) We reserve the right to cancel or refuse any order or service requested at our discretion and prompt refunds are made if payment is already received. Reasons for doing so can be stock levels, or if Quality Control has decided the goods are not of the quality to be ship worthy.
i) We reserve the right to modify prices without notice or apply discounts from time to time while a product is being shipped. There can not be a price match promise for any of our products and services with third-party or our store at a different time stamp. The price we charge is for the goods at the time of purchase only.
6. Delivery of Products
a) We will arrange for delivery of the products you order by the method and to the address which you specify in the check-out procedure. However, the time for delivery will not be essential to the contract between us.
b) If you do not take delivery of the products or supply adequate delivery instructions, we may cancel your order and retain the products. In this event, we will refund you the price of the products, but you will still be liable to pay any delivery charges.
c) If there is an error or any other delivery problem in respect of the products ordered, you must notify us in writing within 14 days after the delivery date. We will not be liable for any loss or damage if you fail to do this.
e) Please ensure the delivery information is accurate and if you have other requirements to take the delivery, then do let us know at the same time as you make the order. All CleverBotanic's shipments are made via Royal Mail unless otherwise stated and we are not accountable for delays caused by an incorrect address entry or delivery information and we reserve the right to charge you extra postage if the original Address given was incorrect. Where an order has been cancelled or delayed due to supply issues, CleverBotanics will take all reasonable measures to inform customers and provide updates where necessary.
7.Cancelling Orders
a) You may cancel your order by notifying us in writing at any time up to 14 days after your products have been delivered. The notification should state your order number and give the reason for cancellation.
b) If you cancel your order after we have despatched the products, then you must return the products to us at the address mentioned above. The products should be returned in a reasonable condition and at your own expense. We recommend the use of a Recorded Delivery Service.
c) You can no longer cancel your order once you have opened the product containers or used the products. However, your statutory rights concerning the quality of those products will be unaffected.
Refund Policy for The UK Dispatch
A fourteen-day refund policy applies to all the products we sell in our webshop. If find that the product you have received does not match the description or the quantity is incorrect or you find other issues with the product then, please contact us no later than fourteen-days from the date of purchase and notify us with details of the product and the order number and a detailed description of the issue. You can also reach us with completing our contact form here. Please ensure that the original packaging is used where possible and the products are unopened to be eligible for a refund. Postage costs are non-refundable. If the refund is accepted then please do send the goods back to us within seven days.
Refund Policy for Overseas Purchases
All the above terms do apply for overseas shipments. However we do not cover import duty you may have incurred or the postage costs. Where a product is being returned, it must be in its original packaging and unopened to be eligible for a refund. Postage costs are non-refundable. If the refund is accepted then please do send the goods back to us within 7 days.
8. General
a) The products advertised in the Web Site/Web Shop/Mobile Apps are intended for sale to persons dealing as consumers and are not for re-sale.
b) The Contracts (Rights of Third Parties) Act 1999 shall not apply to any contract between us, so that no contractual rights are conferred on third parties.
c) Any contract between us shall incorporate these terms and conditions and be under English law. If there is any dispute, the English Courts will have exclusive jurisdiction.
9. Hemp Flowers sold in the webshop.
All of our raw hemp flowers come from carefully processed European hemp strains grown for horticultural purposes within the European Economic Area and are imported legally. They originate from crops that contain less than 0.2% THC required by European law. Under European law, the trade of hemp is protected and does not exclude any part of the hemp plant. Community law precludes any European member state from applying national legislation which, contrary to regulation No. 1782/2003, has the effect of prohibiting the possession of hemp.
